    A Last Will and Testament is a legal document that communicates your final wishes regarding your assets.

    A good Will:

    • ensures efficient handling of your Estate;

    • can last, without needing alterations, for decades;

    • specifies, if applicable, who cares for any minor children should the need arise.

  • Personal Directive

    A Personal Directive is the document in which you appoint an individual(s) to act on your behalf concerning non-financial matters, such as your health, medical care and housing. The Personal Directive only comes into effect if you medically lack capacity.

    If you become incapacitated and there are any doubts about a particular decision that might not be addressed in your Personal Directive, then the person you assign as your agent must make decisions based on their understanding of your wishes, beliefs and values.

  • Enduring Power of Attorney

    Your Enduring Power of Attorney* is the document in which you appoint an individual to act on your behalf concerning legal and financial matters. They look after your assets and liabilities while you are still alive, including dealing with your taxes. This individual ensures your affairs are overseen properly and with your best interests in mind.

    Your Power of Attorney comes into effect

    • if you become incapacitated, or;

    • if you choose to permit them to act on your behalf.

    *Note: the use of the word 'Attorney' can be confusing. This person is not a lawyer. They are simply the person authorized under this document and the Powers of Attorney Act (Alberta).

What happens if I don’t have these documents?

If you do not have these documents in place and you become mentally incapacitated, your family, through a lawyer, would typically need to apply to the Court to appoint someone to handle your affairs. This may unfold contrary to what your wishes are and it might not be handled in an appropriate timeframe. It would also cost more money than if these matters were taken care of while you were still able.

With these documents in place, your family can focus on caring for you rather than navigating the legal and medical systems.
